Do You Qualify for a Short Sale?The original concept of a short sale is when a home sells for less than the mortgage(s) on it. The homeowner may or may not sign a promissory note or bring money to closing. Many homeowners in Orange Park and Fleming Island have not one, but two or three mortgages, including a home equity line of credit.  You may be considering a short sale, but the question is - Do You Qualify for a Short Sale? Not every Clay County homeowner does insofar as no financial penalty. Here's the thing:

The rules for short sales keep changing

If a home is not sold as a short sale and goes into foreclosure, all the mortgages may be wiped out except first mortgage, so any second or third mortgages may be a total loss to their respective bank.  Second and third mortgages are often held by different banks from the first mortgage. A year ago a second mortgage would accept from zero dollars up to $1000 payment and agree to a short sale. So would home equity lines of credit. Not now. 

Today, the second lien holder often demands $3000-5000 from the first mortgage bank to agree to a short sale, and they may demand sellers sign a note agreeing to pay back a portion of the loan. Banks have figured out a way to recoup some of their huge losses by demanding some cash now and a promise to pay later. Additionally, some homeowners are also required to bring money to the closing if the bank determines they are in a financial position to do so.

Please note that if a prior promissory note has been signed on any of the mortgages, the bank can still come after the parties and obtain a judgment after the sale. A breach of contract has a long time period, so it can be years after the short sale that the bank can still come after the borrower. This is important to negotiate at the time of the short sale to have this waived.

It is not part of this discussion, but one of the comments mentioned liens that survive a foreclosure. There are liens that do, such as Federal tax liens, child support liens and construction liens. Check with professional legal/financial counsel for others. The liens for the purpose of this discussion are the mortgage liens.

So who qualifies for a short sale?

Homeowners with a genuine hardship who owe more money than their home is worth due to: job loss, medical reasons, divorce, or relocation that deplete a home owner's assets are considered by banks to be genuine hardship. In this instance, a bank will typically agree to a short sale and not demand cash at closing or a promissory note (but that doesn't mean prior promissory notes signed at the time of the loan may not come up later - this has to be negotiated to be waived).

So who may not qualify for a penalty-free short sale?

1. Homeowners who realize their home is worth less than what they paid and they just don't want to make the payments anymore.

2. Homeowners who have significant assets and income.

3. Homeowners who have bought a second home.

4. Investors.

Please note that there are always exceptions and in some areas banks may be more lenient with negotiating due to the number of short sales and foreclosures in those markets. The observations here are what we are seeing in our market. There are situations where the borrower who can be in the investor, second home, significant assets, or just upside and wants out category walks away with little or no money out of pocket or without signing a promissory note, but in our market and our experience, this is an exception.

Homeowners who qualify for a short sale as of now will usually not be asked by the bank to execute promissory notes for any balance owed. Homeowners who do not qualify for a penalty-free short sale may be required to either sign promissory notes and/or bring cash to closing or the property will go into foreclosure.

What should you do if you are behind in your payments?

If you are behind in your payments, call your bank(s) and keep communications open. Ask to speak to someone in the Loss Mitigation Department. You may qualify for a loan modification or another program. Seek the advice of your financial adviser, accountant and attorney to give you all the information about your particular situation.

So should you do a short sale or not?

Short sales affect your credit for two years. After two years, you may buy a home again. Foreclosures impact your credit for five Do You Qualify for a Short Sale?years. Bankruptcy has a more negative impact than a short sale also. Donna Bigda has written an excellent post covering this subject.

About 20% of homes on Fleming Island on the market are short sales or bank owned and 38% of homes in Orange Park are short sales or bank owned, so you're not alone in the decisions you are facing. 5 Ways to Protect Your Buyer When Building a Custom Home

Mediterranean Home New ConstructionWorking with custom home builders and their buyers is a very exciting, fun part of our business. At least it is for me. I have had the privilege of working with some master builders who pride themselves in their craft and the product they build.

This week, I found out about a local builder who has left four or five buyers high and dry with unfinished homes that have multiple liens filed. How can that be? Didn't the builder sign the lien-release form each time he took a draw? Wouldn't the subs have complained to the homeowner each time they visited the property while they were working? Apparently not.

The person I talked to was completely blindsided and so were the other buyers. The builder's life situation changed dramatically for personal reasons and the money is gone! Where? Don't ask. You can imagine.

So how can you and your buyer be protected when working with an individual or small company?

1. Require that bank draws are made out to both buyer and builder's names.

2. Ask to see the paid invoices for the subcontractors on the job.

3. Call the subcontractors or talk to them on the job periodically to see if they have been paid.

4. Ask them to let you know if they hear of anyone who hasn't been paid.

5. Check with public records once every couple of weeks to see if any liens have been filed.

Custom builders build dream homes. There are many respected, responsible men and women in the industry with sterling reputations. As with any business relationship, work with your buyer to protect their interests so they can build their dream home!

Chinese Drywall - What You Need to Know

New Construction Jacksonville FLRemember when concrete was in short supply? When it was rumored that ships were turning around from delivery to Florida ports heading for China? Turns out drywall was in short supply also.The solution came from China - and now Chinese drywall has become a nightmare for some homeowners, home buyers, builders, and their agents.

Effective immediately, our company is requiring us to sign a Chinese Drywall Disclosure on Listing Agreements and Purchase Agreements.

Apparently, this product may cause the release of sulfur and other materials which could pose health risks. The fumes may cause air-conditioning evaporator coils to corrode and fail, and pipes and wiring to deteriorate. It also corrodes jewelry and mirrors.

Our company is being proactive to protect our Sellers and Buyers. Beginning immediately, a Disclosure must be signed with every contract and listing agreement.

The Wall Street Journal's article pinpoints the problem to Florida. I'm guessing Florida isn't the only state to have this product, but happens to be one of the states where the most building was taking place. In fact, there are some references to post-Katrina homes in one Google link.

Another article on Google indicates the drywall wasn't sold at Home Depot and Lowe's.

How do I know if the home I own/want to buy has Chinese drywall? (Great question, Missy Caulk.) According to an inspector we know and trust (who is also a contractor), the only reliable way is to contact the builder of the home and find out who his supplier was and where the drywall came from. He said he is being contacted daily with offers of tests for this product, however he is doing his homework and waiting to see their track record before offering this service to his clients. Wise man. You know there are lots of folks trying to make a quick buck. He also said that industry information points most of the product was used in the Miami area.

According to a memo provided to Watson New Home Sales by Certified Building Inspectors in Maitland, FL , most of the problem drywall was imported through a German-based manufacturer, Knauf Group, operating in China.

Builders who used the Chinese drywall, documented by themselves, customers and attorneys, include Taylor Morrrison, WCI Communities, Meritage Homes, Ryland Homes, Standard Pacific Homes, Aubuchon Homes and Lennar Homes.

The Florida Health Department has posted a website with photos illustrating the effects of Chinese drywall in a home.

 So, fellow real estate agents and consumers, be alert when showing/buying and selling homes built in 2003 and later.

Rolling Hills at Lake Asbury in Green Cove Springs, Florida is another wonderful East West Partners community. Orange Park Country Club - Orange Park, FL

Orange Park Country ClubOrange Park Country Club (formal name is Country Club of Orange Park) in Orange Park, Florida is a guard-gated community located off Blanding Boulevard a few miles south of I-295.
